In order to achieve correct regulation of these devices, it is necessary to distinguish them since there are no technical characteristics that differentiate them from each other on the basis of the purposes pursued by those who use them. However, the legislator has moved in this direction and, on implementing the provisions of Directive 2009/136/EC, has included the obligation to acquire the prior and informed consent of users to the installation of cookies used for purposes other than merely technical ones (see Article 1(5)(a) of Italian Legislative Decree 28 May 2012, no. 69, which amended Article 122 of the Code).
In this regard, and for the purposes of this measure, two macro-categories are therefore identified: “technical” cookies and “profiling” cookies.
- Technical Cookies
Technical cookies are those used for the sole purpose of “carrying out the transmission of a communication over an electronic communications network, or as strictly necessary to the provider of an information society service explicitly required by the subscriber or user to provide that service” (see Article 122(1) of the Code).
They are not used for any further purpose and are normally installed directly by the website owner or operator. They can be divided into navigation or session cookies, which ensure normal navigation and use of the website (making it possible, for example, to make a purchase or authenticate oneself to access restricted areas); analytics cookies, similar to technical cookies when used directly by the site operator to collect information, in aggregate form, on the number of users and how they visit the site; functionality cookies, which allow the user to browse based on a number of selected criteria (for example, language, products selected for purchase) in order to improve the service rendered to the user.
The installation of such cookies does not require the prior consent of users, while the obligation remains to provide information pursuant to Article 13 of GDPR, which the site operator, if you use only such devices, may provide in the manner he/she/it considers most appropriate.

- Profiling cookies
Profiling cookies are designed to create user profiles and are used to send advertising messages in line with the preferences expressed by the user during web browsing. In consideration of the particular intrusiveness that such devices may have on users’ privacy, European and Italian regulations require users to be appropriately informed about their use and thus express their valid consent.
